Ms. Shubhra Singh, Additional Advocate General, Haryana. *** Petitioner Deepak Kumar, working as a Clerk in the office of Executive Engineer Haryana State Agricultural Marketing Board, Sirsa respondent No. 4 has brought the present civil writ petition craving for issuance of direction to the official respondents to give him promotion and fix his pay from the date his juniors i.e. private respondents No. 5 to 18 had been promoted and/or in the alternative praying for quashing of the final Gradation list of Clerks as it stood on 1.12.2016 published on 4.7.2018 subject to final outcome of LPA No. 311 of 2012.

According to the petitioner, he had submitted several representations and got served a legal notice upon the respondents before filing of the petition but those did not evoke any response, as such he has filed the present writ petition. Keeping in view the nature of the controversy, I find that the official respondents should be given an opportunity to consider the claim of petitioner and if some action in the matter is warranted then to do the PARVINDER SINGH 2021.09.

CWP No. 18517 of 2021 needful to avoid unnecessary litigation. Accordingly, the present writ petition is disposed of directing respondents No. 1 to 4 specially respondent No. 2 Chief Administrator, Haryana State Agricultural Marketing Board, Panchkula to consider the claim of petitioner and then to take appropriate action, if need be in accordance with law, rules, regulations and instructions on the subject within a period of three months from the date of receipt of copy of the order and if some action in the matter is warranted then the needful be done in accordance with law. A speaking order in that regard be passed which be conveyed to the petitioner. For this purpose the present writ petition along with annexures be taken as representation by the petitioner. If the petitioner feels dissatisfied after passing of the order then he may approach the Court again in accordance with law. (H.S.
