Petitioner is serving as a District Ayurvedic and Unani Officer since 19.7.2012. He was posted at Rupnagar on 31.12.2013. By filing present writ petition he has challenged the order dated 10.7.2017 (P-5) whereby he has been transferred from Rupnagar to Gurdaspur. The challenge is primarily based on the ground that the petitioner is to reach the age of superannuation of 58 years in February 2018 and thus the transfer was in violation of the transfer policy. This Court while issuing notice of motion on 17.7.2017 had stayed the transfer order of the petitioner.

At the time of hearing an affidavit dated 16.11.2018 of Sh.Rakesh Sharma,Director Ayurveda,Punjab has been filed wherein it is stated that vide subsequent order dated 16.10.2017 (Annexure R-2/1) the transfer of the petitioner was cancelled and the writ petition has become RAJINDER PARSHAD JOSHI 2018.11.20 17:26 I attest to the accuracy and integrity of this document

CWP 15214/2017 infructuous.

In view of the aforesaid stand of the State writ petition is dismissed as having become infructuous.
