Present writ petition has been filed under Article 226 of the Constitution, inter alia, for directing the respondents to grant pay scale of PR Chowkidar.

In response to notice of motion, short reply by way of affidavit dated 22.04.2019 of Sh. Mangal Dass, District Controller Food Civil Supplies and Consumer Affairs, Sangrur, on behalf of respondent Nos. 1 to 3, has already been filed and para-2 of the same reads as under:- " That no cause of action survives in the present writ petition as the petitioner was given the same pay scale and other benefits, as is being given to the other similarly situated employees in compliance of the order dated 26.02.2018 passed by Director, Department of Food Civil Supplies and Consumer Affairs, Punjab-cum-Managing Director Pungrain. True translated copy of the speaking order dated 26.02.2018 is attached as Annexure R-1. "

A perusal of the above extract reveals that necessary relief has already been granted to the petitioner, as is being given to other similarly situated employees.

Faced with the above situation, learned counsel, on instructions from petitioner, does not press the present petition any further; however, submits that in case something survives, liberty be granted to petitioner for taking remedy as per law before the quarter concerned. 5.

Disposed off with aforesaid liberty.
