The petitioner has approached this Court under Article 226 of the Constitution of India, seeking a direction to the respondent-Authorities to bring the Skynet Enclave strictly in accordance with the sanctioned layout plan dated 04.08.2004 and 07.02.2005 (Annexures P-2 and P-4, respectively) in the light of the Punjab Apartment Property Regulation Act, 1995.

After arguing for some time, learned counsel for the petitioner submitted that he may be allowed to withdraw the instant petition, with liberty to the petitioner to avail the alternative remedy to approach the Civil Court by way of filing a civil suit as certain disputed questions of fact are involved in this case.
