-.- AMIT RAWAL J. (ORAL) Case of petitioner is that he participated in event of Volleyball and obtained second position in 57th State Level Senior Secondary School (Men and Women) Volleyball Tournament held from 21.09.2012 to 26.09.2012 at Govt. High School, Anta Garh, District Bara, Rajasthan. Petitioner submitted an application (Annexure P-4) to District Sports Officer, Sirsa for issuance of Sports Gradation Certificate. Though policy of 1993 has been revised with new policy of 2018, clause of domicile of Haryana would come to rescue of the petitioner, as petitioner is a resident of Haryana. Even condition in new policy of not representing State/UT other than Haryana at national level for issuance of gradation certificate has not been found correct in decision rendered by Division Bench in 22328 of 2018 decided on 11.12.2018.
I am afraid aforementioned argument would not be sustainable for simple reason that event of petitioner was held in 2012 and at that time, policy of 1993 was in vogue. As per policy of 1993, domicile of Haryana would only apply, in case petitioner has PANKAJ KUMAR 2019.07.19 18:10 I attest to the accuracy and integrity of this document
CWP No.18915 of 2019 (O&M) -2participated in events mentioned at Sr. No.1 i.e. Olympic, which is not so in the present case, thus, District Sports and Youth Affairs is not competent authority to issue sports gradation certificate. Petitioner is not able to show any clause in sports policy in order to make him eligible for consideration to Group D post applied for. No ground for interference is made out.
Dismissed.
