Advocate General, Punjab. ***** SHEEL NAGU, CHIEF JUSTICE (Oral) The petitioner has filed this petition for grant of regular bail in case FIR No. 85 dated 27.07.2024 under Sections 127(2), 309(2) of Bharatiya Nyaya Sanhita-2023 and Sections 25, 27, 54, 59 of the Arms Act registered at Police Station Khuian Sarwar, District Fazilka, Punjab. 2.

The petitioner is in custody for the commission of offences of robbery and wrongful confinement since 09.08.2024. 3.

It is not disputed by the learned State counsel that complainant in the trial has been examined and therefore, possibility of the petitioner influencing the main witnesses gets obviated. 3.

In view of the above, the petition stands allowed but with some stringent conditions as the petitioner has criminal antecedents and the petitioner is granted regular bail subject to his furnishing bail bonds for a sum of Rs. 50,000/-with two sureties of the like amount each to the satisfaction of trial Court/Duty Magistrate.

This order shall also remain subject to the following condition:- i) During monsoon season, the petitioner shall plant 10 saplings of indigenous plants at a public place and submit proof in that regard by way of photographs before the concerned trial Court within a period of 15 days and if there is no such intimation submitted or intimation is found to be incorrect, then the State can move an application for cancellation of his bail.
