**** AJAY KUMAR MITTAL, J. (Oral) Learned counsel for the petitioner states that the contract was awarded to the petitioner on 03rd April, 2017 (Annexure P-5) for a period of one year commencing from 01st April, 2017 to 31st March, 2018. 2.

It was inter alia submitted that the said contract (Annexure P-5) has been cancelled vide letter dated 08.05.2017 (Annexure P-11) without affording any opportunity of hearing as well as assigning any reason therein. It was contended that in such circumstances Annexures P-11 and P-12 are unsustainable.

At this stage, learned counsel for the petitioner submitted that after filing of the present writ petition, it has come to the notice of the petitioner that the new contract has been awarded to a third party and inadvertently, the same could not be impleaded. Therefore, a request for withdrawal of the present writ petition has been made with liberty to file a fresh writ petition on the same cause of action by impleading the person to whom the new contract has been awarded.
