G.S.SANDHAWALIA, J. (Oral) The petitioners seek regularization of services from the date their juniors have been regularized i.e. 01.04.2011 and for further direction to the respondents for releasing all consequential benefits arising out of it. It is the case of the petitioners that they joined the Education Department in the year 1998 to 2002 in various capacities in class IV employees. The petitioners were regularized vide regularization orders dated 25.08.2014 (Annexure P-1 colly) and their grouse is that other persons who had joined subsequently have been regularized prior in point of time. Counsel has made reference to Annexure P-3, the order dated 30.11.2012 to contend regarding the said fact. Counsel submits that legal notice dated 25.02.2017 (Annexure P-5) has already been served upon the respondents regarding the said aspect but the same has not been decided. Counsel further submits that he would be satisfied if a direction is issued to the respondents to decide the said legal notice within a fixed time frame.

Without commenting on the merits of the case or the entitlement of the petitioners for the abovesaid relief and keeping in view the fact that the matter is still pending consideration, the present writ petition is disposed of with direction to respondent no. 3 to take a decision on the said legal notice dated 25.02.2017 (Annexure P-5) within a period of 3 months from the date of receipt of certified copy of the order. Needless to say if the benefit is to be declined, a reasoned order be passed and the same be conveyed to the petitioners.
