The petitioner seeks grant of regular bail in respect of a case registered against him vide FIR No. 140, dated 28.4.2022, Police Station Maqboolpura, District Amritsar under Sections 379-B, 34 of IPC.

As per the case of prosecution, the petitioner along with co-accused Sunny had snatched an amount of Rs.2500/- from the complainant forcibly while brandishing a pistol.

Learned counsel for the petitioner submits that he has falsely been implicated in the present case and that the pistol allegedly recovered from the petitioner is in fact a toy pistol.

Opposing the petition, learned State counsel submits that since the petitioner was apprehended at the spot, his complicity cannot be doubted. Learned State counsel has however, informed that as on date the petitioner has been behind bars for the last 7 months and he is not involved in any other case.

This Court has considered the rival submissions. 6.
The petitioner has been behind bars for a substantial period of 7 months and otherwise has a clean record. Conclusion of trial is likely to consume time. In these circumstances further detention of the petitioner will not serve any useful purpose.
