CORAM:
HON'BLE MR. JUSTICE MAHESH GROVER HON'BLE MR. JUSTICE AMIT RAWAL
Present:
Mr. A.S. Walia, Advocate for the petitioner.
Mr. H.S. Sitta, AAG, Punjab.
Mr. Harit Sharma, Advocate for the respondent(s)-GMADA. **** MAHESH GROVER, J. (ORAL) Concededly, there is a remedy of appeal under Section 45 (5) of the Punjab Regional and Town Planning and Development Act, 1995. The petitioner, if so advised, may take recourse to his remedy. We in the exercise of writ jurisdiction cannot entertain this petition, where the petitioner himself has defaulted in making payment as per schedule and now questions the demand raised by the respondents. However, in case such appeal is filed within a period of one month from today, the question of limitation will not come in the way of the petitioner and the appeal shall be decided on merits. The present writ petition stands disposed of. ( MAHESH GROVER) JUDGE ( AMIT RAWAL ) JUDGE 12.10.2018 Yogesh Sharma Whether speaking/reasoned Yes/ No Whether Reportable Yes/ No
