Petitioners are said to have purchased the land measuring 2K 5M from respondent Nos.5 to 7. Thereafter they statedly constructed some shops to earn livelihood. The land alongwith structure has been acquired by State of Haryana. It appears that mutation earlier sanctioned in favour of the petitioners was changed against which they filed civil suit and it was decreed in their favour. Meanwhile, the previous owner, who was still recorded as the owner of the acquired land is said to have filed reference under Section 18 of the Land Acquisition Act, 1894 (for short,`the 1894 Act') for enhancement of compensation for the acquired property.
The compensation amount in respect of the disputed property has not been released so far. Since petitioners are claiming themselves to be the true owners on the strength of registered sale-deed duly upheld by Civil Court, we dispose of this writ petition with liberty to the petitioners to file either a petition under Section 30 of the 1894 Act or put up their claim before Meenu 2016.09.23 15:00 I attest to the accuracy and authenticity of this document chandigarh
