(ORAL) The instant writ petition has been filed under Article 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing the action of the respondents vide which prayer of the petitioner for transferring him from the Dog Squad to any other office on account of his health condition has been rejected. Counsel for the petitioner herein would contend that the petitioner is suffering from 'Bronchial Asthma' and is allergic to dog hairs. It is further contended that he had approached the authorities concerned to transfer him to any other office vide representation (P-4) and legal notice (P-6) but no positive action has been taken thereon so far. It is also contended that the petitioner herein would be satisfied in case the writ petition is treated as a fresh representation on behalf of the petitioner and decided within a time bound manner, while taking into account medical condition of the petitioner as well as the fact that he is going to retire within two years.

Without going into merits of the case, this Court deems it appropriate to direct the respondents to treat the instant writ petition as a fresh representation on behalf of the petitioner and take a decision thereon within a period of four weeks from the date of receipt of certified copy of this Court by passing a speaking order, which will be communicated to the petitioner forthwith.
