(ORAL) Having suffered concurrent adverse findings by both the Courts below, appellant/plaintiff No.2 is in second appeal before this Court assailing learned trial Court judgment and decree dated 20.01.2006, as upheld by learned First Appellate Court vide its judgment and decree dated 31.08.2006, dismissing suit of the plaintiffs seeking a decree for declaration to the effect that impugned decrees passed in Civil Suit No.57 of 1974 dated 10.06.1975 and subsequent Civil Court decrees passed on the basis of impugned decree dated 10.06.1975 as mentioned in plaint along with all revenue record and all other transactions on the basis of wrong revenue entries and impugned decrees were wrong.

Matter was taken up for hearing on 21.02.2003 when learned counsel for the parties sought time to get instructions, if anything survives in the matter since appeal was filed way back in the year 2006. On resumed hearing today, learned counsel for appellant once again pleads lack of instructions. It seems that appellant is not interested in pursuing the appeal.

Be that as it may, dismissed for non-prosecution with liberty to the appellant for moving application to revive proceedings, in case, anything survives as learned counsel is not able to get instructions from the client.
