In the present petition, the prayer of the petitioners is for issuance of direction to respondent No. 2 to give salaries to the petitioners for the higher post as the petitioners are working on a higher post of Dental Assistant-cum-Dental Mechanics but they are not being paid the salary for the said post and that too without any valid justification. 2.

Learned counsel for the petitioners submits that keeping in view the settled principle of law, employees are entitled for the salary for which they are discharging their duties. Hence, the respondents are under obligation to pay the salary to the petitioners for the post of Dental Assistant-cumDental Mechanics from the day, when the petitioners started discharging their duties on the said post alongwith arrears. Learned counsel for the petitioners further submits that the said grievance has already been brought to the notice of the concerned authorities through representation dated 23.11.2021 (Annexure P-11) and representation dated 18.03.2023 (Annexure P-12), which are still pending consideration before the authorities concerned and petitioners will be satisfied if direction is issued to respondents-authorities to decide the above representations in a time bound manner RIYA 2023.07.26 11:26 I attest to the accuracy and integrity of this document

Mr. Pankaj Middha, Addl. A. G. Haryana, who is present in Court, accepts notice on behalf of State of Haryana-respondents 5.

Learned State counsel submits that in case the representations i.e. Annexure P-11 & 12 have already not been decided, the same will be decided within a period of eight weeks from today by passing appropriate speaking order and in case, after the passing of the speaking order, petitioners are found entitled for any benefit, the same will also be extended within further period of four weeks.

Learned counsel for the petitioners submits that keeping in view the statement of learned State counsel, no further grievance of the petitioners is survives, hence, the present petition may kindly be disposed of having been not pressed any further.
