(ORAL) Counsel for the peƟƟoner submits that he wants to withdraw the present peƟƟon with liberty to file an appropriate applicaƟon under the NegoƟable Instruments Act, 1881 and the judgment of Hon'ble the Supreme Court in the case of M/s Meters and Instruments Versus Kanchan Mehta, Appeal (Crl.) 1731 of 2017. 2.
Given above, the present peƟƟon stands disposed of having been withdrawn with liberty to take all these points in the said applicaƟon. It is clarified that filing and closure of the present peƟƟon shall not come in the way of the trial Court while deciding the said applicaƟon. In case, the peƟƟoner is sƟll aggrieved, liberty again reserved to come to this Court again. The pending miscellaneous applicaƟons, if any, are also disposed of as such.
