C.M. No. 3357-2024 The present application is for preponing of the date of hearing of the main case.

Issue notice of the application.

On asking of the Court, Mr. Swapan Shorey, D.A.G. Punjab, accepts notice on behalf of the respondent-State and has no objection. After going through the contents of the application, the same is allowed and the main case is taken on board today itself for disposal. C.W.P No. 14616-2023 Reply by way of counter affidavit on behalf of respondent Nos. 1, 2 and 5, is taken on record.

The prayer in the present Civil Writ Petition filed under Articles 226/227 of the Constitution of India, is for directing the respondents to release the death-cum-retirement gratuity, arrears of pay, commuted pension and for release of 100% pension to the petitioner along with arrears.

Learned counsel submits that as per para No. 8 and 9 of reply filed today, the pension case of the petitioner has been submitted to the office of Accountant General (A&E Branch), Chandigarh vide letter dated 31.01.2024 (Annexure R-5), however, the amount has not been released. The Paras referred to above read thus:- "8. That thereafter, the petitioner gave representation alongwith requisite documents on dated 14.11.2023 to the office of Respondent No. 5. The matter was considered and accordingly retiral benefits were sanctioned to the petitioner. The bills in this regard are submitted for payment in the treasury Office Talwara on dated 24.01.2024. That now the petitioner on her own has also submitted a representation 9. alongwith a declaration dated 30.01.2024 (R-6) stating therein that her request for the grant of appointment on compassionate basis may not be considered and she has no objection and will not approach any court of law if in case the same would be given to her unmarried daughter namely Ms Priyanka. The matter in in this regard is under consideration of the Respondent Department."

Learned counsel submits on instructions that the petitioner would be satisfied, if a direction is given to the respondents to release the aforesaid amount in a time bound manner.

Learned State counsel has no objection to the limited prayer made.
