Instant application under Section 528 of the Bhartiya Nagarik Suraksha Sanhita 2023 (BNSS) has been preferred seeking withdrawal of the main petition, i.e. CRM M 36066 2022, which is already fixed for hearing on 13.11.2024.

Learned counsel for the applicant petitioner submits that the petitioner had sought quashing of the FIR in the main petition and in the meanwhile, police after investigation has preferred the cancellation report therein.

Keeping in view the aforesaid request and the averments made in the application, in the interest of justice, application is allowed and the main case which is fixed for hearing on 13.11.2024 is taken up on Board today itself, i.e. 16.09.2024.

Learned counsel for the petitioner seeks withdrawal of the instant petition on the ground that petitioner has sought quashing of the FIR No. 128 dated 20.02.2022, under Sections 418, 420 IPC, registered at Police Station Faridabad Kotwali, District Faridabad, (Annexure P 1) and during the course of investigation, police has filed the cancellation report before the learned Illaqa Magistrate. As such, the petitioner does not intend to pursue the present petition and seeks withdrawal of the same.

In view of the aforesaid submissions, instant petition is dismissed as withdrawn with the liberty to file the same afresh in case so required in future in accordance with the law. 3.
