* * * * Kanwar Singh filed a petition for divorce under Section 13 of the Hindu Marriage Act, which was allowed and a decree of divorce was granted vide order dated 06.12.2008. The wife filed present appeal. Learned counsel for the parties, the Mediator as also the parties to this appeal have come present. They were heard. Suman, the appellant-wife and Kanwar Singh, the respondent-husband have made statements, recorded separately, wherein both of them stated that they are living together as husband and wife for the last more than 07 years and thus, prayed that the appeal be allowed and the judgment and decree under appeal be set aside. In view of their statements and keeping in view the fact that they are living together for the last more than 07 years as husband and wife, the appeal stands allowed and judgment & decree under appeal is set aside in terms of their statements.
