(Oral) In deference to the order dated 19.09.2015, the Deputy Commissioner-cum-District Election Officer, Mewat has filed his affidavit explaining that after receipt of the abovestated order, Sub Divisional Officer (Civil), Feorzepur Jhirka was asked to submit an urgent report after visiting the village and ascertaining the facts. The Sub Divisional Officer (Civil) has submitted his report dated 15.09.2015 observing that booth No.167 comprises Ward Nos.7, 8 & 9 of the Gram Panchayat out of which Ward Nos.7 & 8 are reserved for Scheduled Caste Category and there is prevailing tension in the village with respect to the panchayat elections and that in the Parliamentary and Vidhan Sabha elections already held, booth Nos.

61 & 62 were located at separate places, namely, Government Middle School and Scheduled Castes Chaupal, respectively. It was further recommended that following the same pattern, polling booth No.167 covering Wards Nos.7, 8 & MOHINDER KUMAR 2015.10.

CWP No.20004 of 2015 [2] 9 can be located in the SC Chaupal. Para No.5 of the affidavit further says as follows:- ".... 5. Accordingly, in view of the representation of the petitioners, the prevailing situation as well as report of Sub Divisional Officer (C), Ferozepur Jhirka-cumReturning Officer, Punhana, it has been decided to locate polling booth No.167 in SC Chaupal Village Naiwana...."

In view of the fact that the polling booth for the voters belonging to SC community has now been segregated and shifted at a new place which functioned well in the previous elections also, we are of the considered view that the grievance and apprehension expressed by the petitioner has been adequately redressed. No further direction thus is called for.

We have no reason to doubt that the authorities are fully conscious of ensuring fair and free election in an area like the one in the instant case which has been notified as hyper-tension area.

The writ petition stands disposed of accordingly. Dasti.
