The present writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of an appropriate writ, order or direction, particularly in the nature of Mandamus, directing the respondents to release the amount of death-cum-retirement gratuity (DCRG)/Death Gratuity payable to the petitioner upon the death of her husband during

service, along with interest @ 18% per annum on account of the inordinate and illegal delay in releasing thereof and further directing the respondents to decide the legal notice dated 04.08.2025, Annexure P-1, within a time-bound manner.

Learned counsel for the petitioner submits that he would be satisfied if the legal notice dated 04.08.2025, Annexure P-1, of the petitioner is decided by the respondents by passing a speaking order in a time bound manner.

Mr. Ankit Gaur, Advocate, appearing through hybrid mode on advanced notice, submits that he has no objection in case a direction is issued to the respondents for time-bound consideration and decision of the legal notice of the petitioner by passing a speaking order. 4.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, respondents No.6 and 7 are directed to consider the legal notice, Annexure P-1, of the petitioner and pass a speaking order, after affording her an opportunity to be heard, within a period of 02 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. 5.

Needless to say, in the event the petitioner is found entitled to the relief claimed, she shall also be entitled to interest @ 6% per annum, to be calculated after the expiry of two months from the date of death of the

deceased-employee i.e. 21.10.2019, and the same shall be released forthwith by the respondents.
