(Oral) The petitioner is seeking issuance of direction to the respondents to reinstate him into service as 'Head Warder' from due date along with all consequential benefits, as the petitioner was acquitted in F.I.R No. 318 dated 02.10.2015 under Sections 18/21/22/85 of NDPS Act, vide judgment dated 24.05.2019.

The petitioner was appointed on 07.03.1985 and the above F.I.R was registered against him on 02.10.2015. A charge sheet was issued to the petitioner on 16.10.2015. On 18.03.2016, he was served with show cause notice and he gave his reply dated 05.05.2016. Subsequently, he was dismissed from service on 30.09.2016. Against this order, the petitioner preferred an appeal before respondent No. 1, which is still pending. The petitioner gave reminder but to no effect.

Petitioner has also given legal notice dated 20.07.2020 (Annexure P-12) to decide his appeal, which is still pending consideration GAURAV ARORA 2020.10.15 16:50 I attest to the accuracy and integrity of this document Chandigarh

CWP No. 17193 of 2020 with respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to respondent No. 1 to decide his appeal. Issue notice of motion.

On asking of the Court, Ms. Akshita Chauhan, AAG, Punjab accepts notice on behalf of respondent-State. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondent No. 1 is directed to decide the appeal dated 25.10.2019 (Annexure P-10) expeditiously, preferably within a period of four months from the date of receipt of a certified copy of this order.

Present writ petition stands disposed of.
