Prayer in this writ petition is for issuance of direction to the respondents to grant all retiral benefits stated to be due to the petitioner, including gratuity, leave encashment etc.

Learned counsel for the petitioner submits that petitioner retired from the post of Secretary from Kapuri Multipurpose Cooperative Agricultural Service Society Ltd., Kapuri, Tehsil Rajpura, District Patiala, on 30.09.2020. Claim of the retiral benefits of petitioner, it is submitted, has been passed vide resolutions dated 02.06.2021 and 02.06.2022 by the respondent-Society and sent to respondent no.4 for getting it pre-audited from Inspector, Circle Kapuri, Tehsil Rajpura, District Patiala. The same is sent for pre-audit by the Assistant Registrar, Cooperative Societies, Rajpura. Petitioner has been found entitled to the amount in question after completion of pre-audit, however, payment of retiral dues is not being released in an unjustified manner. It is submitted that in this respect legal notice dated 29.05.2022 (Annexure P-9) was also served but to no avail. SUNIL 2022.08.10 10:45 I attest to the accuracy and integrity of this document

CWP-17135-2022 -2At this stage, learned counsel for the petitioner restricts the prayer for a decision on the legal notice dated 29.05.2022 (Annexure P-9), in a time bound manner.

Keeping in view the facts and circumstances of this case, but without any expression of opinion on the merits of the matter, this petition is disposed of with a direction to the competent authority to consider and decide petitioner's legal notice dated 29.05.2022 (Annexure P-9), by passing a speaking order, in accordance with law, within a period of three months from receipt of certified copy of this order. In case, petitioner is found entitled to any monetary benefits, same be released within the next two months thereafter.

Writ petition is disposed of accordingly.
