The jurisdiction of this Court under Article 226 of the Constitution of India has been invoked for issuance of a Writ in the nature of Habeas Corpus to search and produce minor detenue, daughter of the petitioner, who has been illegally kidnapped/detained by respondents No.4 to 8.

Learned counsel for the petitioner has submitted that minor daughter of the petitioner has eloped with respondent No.4 on 05.03.2026 and an FIR No. 48 dated 08.03.2026 under Sections 137 (2), 87, 61(2) of BNS (corresponding to Section 363, 366, 120-B IPC) has been registered at Police Station, Kartarpur, District Jalandhar Rural.

Pursuant to issuance of notice of motion, status report by way of an affidavit of Narinder Singh, PPS, Deputy Superintendent of Police, Sub Division Kartarpur, Jalandhar, has been filed by the REKHA SIHAG 2026.05.29 17:07 I attest to the accuracy and authenticity of this document Chandigarh

CRWP-5765-2026(O&M) respondent-State, wherein it has been stated after registration of the aforesaid FIR, investigation was commenced by ASI Lakhwinder Singh, who inspected the place of occurrence, prepared its rough site plan and recorded the statements of the witnesses. He also conducted repeated raids at the houses of respondents No.4 to 8 on various dates but they were not found present at their houses. Mobile phones of the private respondents have also been put on surveillance, but they were found to be switched off. Police has also tried to scrutinized their social media accounts to find whereabouts of the detenue but in vain. It has further been stated in para 6 of the status report that respondent No.8-Rajni has been granted concession of pre-arrest bail in the aforeasid FIR and on joining investigation, she has denied about having any information about the whereabouts of the detenue and respondent No.4, however, she has admitted that she used to help them to meet each other and they had eloped on 05.03.2026. 4.

Today, when the matter was taken up, learned State counsel submits that police officials are making sincere efforts to trace out the minor daughter of the petitioner in accordance with law. 5.

In view of the aforesaid facts, the present petition stands disposed of, however, petitioner shall be at liberty to take recourse to any other alternative remedy, available to her, in accordance with law. 6.
