The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to consider him for the post of Constable against advertisement No.8/2015. 2.

The petitioner applied for the post of Constable. There were 5000 posts. The respondent initially declared result of 4500 posts. On account of dispute of reservation for Special Backward Class, result of 500 seats was declared in August' 2019. The merit list was revised. Cut off decreased. It prompted many candidates to approach this Court which includes petitioner. The petitioner is claiming that till date all the seats have not been filled up. Thus, petitioner may be considered. His case is squarely covered by judgments of this Court in "Rahul Dhanda Vs. State of Haryana" CWP-15728-2022 dated 05.08.2025 and "Vinay Vs. State of Haryana and Ors." On being confronted with afore-cited judgments, learned State counsel expressed his inability to controvert applicability of said judgments to the instant case.

The petition stands disposed of in terms of orders passed by this Court in Vinay (supra) and Rahul (supra). 5.

The respondent shall reconsider petitioner's claim and if he is found eligible after granting marks of higher qualification, he would be issued appointment letter. His date of joining will be his date of appointment for all intents and purposes. It is made clear that respondent would be free to examine eligibility of petitioner in all respects. 6.
