Through the instant petition, as instituted under Section 438 of the Cr.P.C., the petitioner seeks the concession of anticipatory bail, in case FIR No.218 dated 22.08.2023, under Sections 148, 149, 307, 160 of the IPC, and, Section 25 of the Arms Act (Sections 323, 325, 201 of the IPC and Section 27 of the Arms Act added subsequently), registered at P.S. Civil Lines, Rohtak, District Rohtak.



2. The learned counsel for the petitioner submits that, neither the petitioner has been named in the FIR, nor any role whatsoever has been attributed therein to him. In fact, a quarrel had taken place between two rival groups, namely, Aman Dahiya Group and Vishesh @ Chhotu Group. There is no allegation that the petitioner had opened any firing, rather the only allegation levelled against the petitioner is that he was present at the time and place of occurrence along with his co-accused.

3. Lastly, the learned counsel for the petitioner submits that five of the petitioner's co-accused have already been enlarged on regular bail by the learned Additional Sessions Judge, Rohtak. Not only this, two of the petitioner's co-accused, namely, Vishesh and Lakshay have also been granted the concession of anticipatory bail respectively by this Court and by the learned Additional Sessions Judge, Rohtak.

5. Mr. Rajesh Gaur, Addl. A.G., Haryana, accepts notice on behalf of respondent-State of Haryana.

6. In the meantime, the petitioner is directed to join the investigation and to appear before the investigating agency, as and when called upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 438(2) Cr.P.C.7
