The petitioners, inter alia, are aggrieved by the list of employees eligible for transfer, prepared by the respondent-Department of School Education, Haryana, the relevant extract of which is annexed as Annexure P-12 with the writ petition.
The petitioners claims themselves to be differently-abled Primary Teachers and for this reason seeks indulgence for removal of their names from the said list. A representation, dated 11.8.2016 (Annexure P14), in this regard was made by petitioner No. 11 to the authorities, which is stated to be pending with the decision-maker. The present petition is disposed of with a direction to the competent authority to decide upon the grievance/representations of the petitioners by treating this petition as a supplementary representation within a period of 7 days from the date of receipt of certified copy of the order. The competent authority in making its decision would consider the law in Shilpi Bose (Mrs.) v. State of Bihar, AIR 1991 SC 532 and Union of India and Prashant Kapoor 2016.09.17 12:34 I attest to the accuracy and authenticity of this document
