This petition has been filed under Section 528 of BNSS (Section 482 Cr.P.C) for quashing of order dated 26.02.2026 passed by ld. Addl.CJM, Bathinda whereby bail order of the petitioner has been cancelled and bail bonds have been forfeited to the State and non bailable warrants of the petitioner have been issued in case bearing CH No. 254 of 2020 titled as "State Vs Himmat Singh and Ors" in FIR No. 259 dated 26.11.2016 under Sections 353,186,332,148,149 of IPC (Section 325 of IPC and Section 52 of Prison Act added later on) (now Sections 132,221,121,191,190 ) and Section 117 added later on of BNS registered at Police Station Nathana District Bathinda. 2.
Learned counsel for the petitioner submits that the petitioner could not appear before the learned trial Court as petitioner was unwell. Consequently, the learned trial Court cancelled the bail granted to the petitioner, forfeited his bail bonds and surety bonds to the State, and issued RENU RAWAT 2026.05.19 17.39 I attest to the accuracy and integrity of this document Chandigarh
CRM-M-28393-2026 non-bailable warrants against him. He further submits that the petitioner is now ready and willing to join the proceedings before the trial Court and prays that the impugned order dated 26.02.2026 be set aside. 3.

I have heard learned counsel for the parties and gone through the case file.

In view of the limited prayer made by the learned counsel for the petitioner, this Court does not find any legitimate ground to interfere in the impugned order dated 26.02.2026 passed by ld. Addl.CJM, Bathinda. However, in case the petitioner surrenders before the trial Court within a period of 07 days from today and moves an application for grant of regular bail, the trial Court is directed to consider and decide the same within a period of three days. 7.
