* * * * S.J. VAZIFDAR, A.C.J. (ORAL) The petitioners were allotted a plot of land on the terms and conditions contained in the allotment letter dated 28.01.2015. 2.
The petitioners contend that by virtue of a letter dated 24.03.2015 from the Housing Board, Haryana, they were in fact deprived of an area of about 26 sq. yards out of the plot which admeasures 317.13 sq. yards. The petitioners claim a proportionate deduction in price on account thereof. The petitioners also contend that the flat is not ready for construction as there are electricity poles still upon the plot. They further contend that other infrastructure facilities are not in place.

The petitioners have already addressed two letters the second of which is a notice of demand for justice dated 17.08.2015. 4.
The respondents shall respond to the said notice dated 17.08.2015 by passing a speaking order by 31.10.2015.

CWP-20096-2015 The petitioners are at liberty to apply for a personal hearing in the matter.
The petitioners can always make an application for extension of time for construction including in view of the facts alleged in the writ petition. That would be for the respondents to consider in the first instance. The petitioners are always at liberty to challenge any directions that may be issued by the respondents.

In the meantime, the petitioners shall be entitled to deposit the amounts as per the allotment letter without prejudice to their rights and contentions.
