It is submitted that though the petitioner was retrenched in the year 1988 itself and admittedly no steps were taken to challenge his retrenchment, he nevertheless claims parity with similarly situated persons, namely, Roop Lal and Bhupinder Singh, who have been appointed on ad-hoc/contingent basis vide Annexure P1 dated 15.06.2010 and Annexure P2 dated 14.01.2010. In response to his application under the Right to Information Act, it is informed by the respondent - Corporation vide communication dated 27.06.2011, Annexure P3 that the appointments were as per orders of the Chairman of the Corporation and not on the basis of any qualification, experience etc. No advertisement was issued in the newspapers for filling up these posts.

CWP No.20118 of 2015 [2] Learned counsel for the petitioner submits that at this stage, legal notice, Annexure P4, issued on behalf of the petitioner be directed to be decided by the respondents.
Keeping in view the limited prayer made on behalf of the petitioner and the facts and circumstances of the case but without expressing any views on the merit of the petitioner's claim, present writ petition is disposed of with a direction to respondent No.1 through its Chairman to decide legal notice, Annexure P4 in accordance with law, preferably within a period of four months from the date of receiving a certified copy of this order. It is made clear that there is no expression of opinion on the merits of the controversy.
