(ORAL) In the present application i.e. CM No.3018-CWP-2019, applicant-petitioner has prayed that the main writ petition be disposed of in terms of order passed by this Court in CWP No.10245 of 2018 titled as 'Surat Chander Versus The State of Punjab and others', decided on 30.01.2019.
In the present writ petition, the claim of the petitioner is for the grant of interest on the delayed payment of retiral benefits. Counsel for the petitioner states that even though the petitioner retired on 31.05.2017, but his retiral benefits were paid to him after an undue and unexplained delay and therefore, the petitioner becomes entitled for interest in view of the law laid by a Full Bench of NARESH KUMAR 2019.03.08 15:03 I attest to the accuracy and integrity of this document Chandigarh

Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, the petitioner has served the respondents with a legal notice on 10.05.2018 (Annexure P-5), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice. Counsel for the respondents states that she has no objection with regard to the prayer made by counsel for the petitioner for passing of the appropriate orders on the legal notice dated 10.05.2018 (Annexure P-5), submitted by the petitioner, in a time bound manner.
In view of the above, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 10.05.2018 (Annexure P-5) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.
Present writ petition stands disposed of.
