On our asking, Ms.Kirti Singh, learned Deputy Advocate General, Haryana, accepts notice on behalf of the respondents.
Let five copies of the writ petition be supplied to the State counsel during the course of day failing which this order shall be automatically recalled and the writ petition shall be deemed to have been dismissed for non-prosecution. In view of the nature of order which we propose to pass, it is not necessary to seek any counter-reply from the respondents at this stage.
The petitioners are husband and wife who seek a direction for deletion of their names from the voter list of Municipal Council, Kaithal and then include the same in the voter list of village Kheri Raewali, District Kaithal. CWP No.20190 of 2015 [2] that after retirement of the first petitioner from Education Department, Haryana, they have settled in the village, hence, they are entitled to cast their votes at the place of their residence in the ensuing Gram Panchayat elections. Since the above-stated claim requires a fact-finding enquiry, we dispose of this writ petition without expressing any views on merits, with a direction to the Deputy Commissioner, Kaithal to look into the above-mentioned grievance of the petitioners and redress the same in accordance with law, within a period of one week from the date of receiving a certified copy of this order.
