Jaswant Singh,J(Oral) 43 petitioners are working as ETT teachers and posted in different Government schools in District SAS Nagar, Mohali. Their grievance is that vide impugned order dated 26.7.2016(P-3) passed by Electoral Registration Officer-cum-SDM Kharar, they have been deputed to function as Booth Level Officers(BLOs) apart from their respective official duties for the ensuing general assembly elections. It is contended that the petitioners cannot be made to function as BLOs in the light of law settled by Hon'ble the Supreme Court in Election Commission of India v St.Mary's School and others 2008(1) RCR (Civil)297.

Upon notice,learned State counsel on instructions submits with utmost responsibility that respondents in due deference to the cited judgment are aware of the mandate of Hon'ble the Supreme Court and none of the teachers including petitioners would be deputed for electoral work during the period of their imparting education to the students so that the Rajinder Parshad Joshi 2016.10.04 18:07 I attest to the accuracy and integrity of this document
