Instant habeas corpus petition has been filed by the petitioner-Ramandeep Kaur, seeking the release of the detenue, namely Jagjit Singh @ Nanna (husband of the petitioner), from the alleged illegal detention of respondent No. 3, S.H.O., Police Station Sadar, Jamalpur District Ludhiana.

On 15.05.2026, following order was passed:- Learned counsel for the petitioner submits that detenue, being the husband of the petitioner, has been illegally picked up and detained by respondent No.3, namely the Station House Officer, Police Station Jamalpur, District Ludhiana, without any lawful authority, reason or registration of any FIR. Since his illegal detention, the detenue has allegedly been subjected to continuous beatings and inhuman treatment at the hands of respondent No.3. Despite repeated requests and visits made by the petitioner and her relatives on 12.05.2026, the respondents failed to disclose the grounds of detention or the offence, if any, in which the detenue has been implicated.
-2- It is further submitted that the detenue has neither been produced before the learned Illaqa Magistrate within the prescribed statutory period nor shown arrested in any criminal case, which amounts to a gross violation of the settled provisions of law and the fundamental rights guaranteed under the Constitution. Having no other efficacious remedy, the petitioner has approached this Hon'ble Court by way of the present writ petition seeking issuance of appropriate directions for the release of the detenue from the illegal custody of respondent No.3.

The Registry is directed to appoint a Warrant Officer, who shall visit the place(s) of alleged illegal confinement of the detenue, as may be pointed out by the petitioner. In case the detenue, Rahul Goyal (brother of the petitioner), is found to be in illegal detention, he shall be released forthwith after recording his statement without any influence, pressure, or coercion. Thereafter, the report prepared by the Warrant Officer shall be produced before this Court on or before the next date of hearing. The usual expenses shall be borne by the petitioner in this regard.

Today, learned State counsel produces a report dated 15.05.2026, prepared by the Warrant Officer appointed by this Court, in a sealed cover, which was opened by the Court Secretary in Court. 4.
As per the report, Warrant Officer reached Police Station Kuiddian Kalan at about 9:35 p.m. on 15.05.2026, where detenue Jagjit Singh was found sitting in the room of the In-charge, Police Post. The Constable present there immediately informed Inspector/SHO Dalbir Singh of Police Station Jamalpur and Police Post In-charge ASI Paramjit Singh, who thereafter reached the spot.
SHO explained that detenue Jagjit Singh had been called in connection with the investigation of FIR No.116 dated 12.05.2026, registered under Sections 109, 32(2), 191(8), and 190 of BNS, along with Section 25 of the Arms Act, at Police Station Jamalpur. He further stated
-3that detenue was not required in any other case and he, along with other persons, had already been released on 12.05.2026, upon furnishing undertaking by responsible persons of the locality. It was specifically stated that detenue Jagjit Singh is no longer required in any case. 5.
In view of the aforesaid report, no further directions are required to be issued in the present petition. Accordingly, present petition stands disposed of, with liberty to the petitioner to avail any other remedy if any, available under the law.
