The respondent filed a suit for declaration that Bill No. 1241, dated 08.11.2008, for the period from 26.08.2008 to 15.10.2008, for a sum of Rs. 1,13,983/- was illegal and for consequential relief of injunction restraining the present appellants from disconnecting the electricity supply. The suit has been decreed by the Trial Court and the appeal has been dismissed.
Learned counsel for the appellants has submitted that the findings of the courts below are erroneous because Ex. D-1 (demand raised for the period in dispute) is Annexure A-2 on record. The said demand shows that the courts below have misread the evidence on record. The submission is meaning less as admittedly the meter of the plaintiff/respondent was changed in July, 2008. Accordingly, the meter reading for August, 2008 should have started from 5 units, as has been PRASHANT KAPOOR 2021.08.23 16:21 I attest to the accuracy and integrity of this document
129 RSA-514-2021 (O&M) mentioned in the order of the courts below. Instead the old reading for the month of August, 2008 reads as '37890'. Thus, the document Annexure A-2 is not document Ex. D-1. Even if it is Ex. D-1 on record, the argument that the same has been misread by the courts below is misconceived. No further point has been raised or argued.
