The grievance of the petitioners in the present case is regarding the non-release of the pension and pensionary benefits to them in view of the law laid down in CWP No.15306 of 2016, decided on 04.09.2017 titled as Hari Ram and others vs. Pepsu Road Transport Corporation, Nabha Road, Patiala (Annexure P-2). Learned counsel for the petitioners would contend that in the said case directions were issued to give 9% per annum interest on the delayed payment of pensionary benefits. Learned counsel would further contend that despite serving a legal notice dated 06.06.2020 (Annexure P-1) the pension and pensionary benefits have not been released to the petitioners. Learned counsel for the petitioners submits that at this stage the petitioners would be satisfied if a direction is issued to the respondent to decide the legal notice dated 06.06.2020 (Annexure P-1).

CWP No.17106 of 2020 -2Since the matter is not being decided on merits, the service of notice on the respondent is dispensed with. Without going into the merits of the case, the present petition is disposed off with a direction to the respondent to decide the legal notice dated 06.06.2020 (Annexure P-1), in accordance with law, within a period of one month from the date of receipt of a certified copy of this order and further to release the pension/pensionary benefits, if any, found due and payable, to the petitioners within a further period of two months.
