Petitioner has filed instant petition under Section 439 Cr.P.C. for grant of regular bail in FIR No.57 dated 15.04.2023 under Sections 304B, 498-A and 34 IPC registered at Police Station Bhupani, Faridabad, District Faridabad.

As per facts of the case, complainant Kuldeep Singh gave his statement that his sister i.e. victim got married with Satnam Singh petitioner about one year ago. She committed suicide by hanging herself on 14.04.2023. Her husband used to beat and harass her everyday. They kept on demanding dowry time and again. Satnam Singh already had illicit relations with some girl. All family members have committed murder of his sister. With these allegations, present FIR was registered and present petitioner along with other co-accused is facing trial.

Learned counsel for petitioner argued that Satnam Singh is falsely implicated in this case. Contents of FIR does not show any specific demand raised by the petitioner. Allegations are vague and without any basis. Petitioner was arrested in this case on 15.04.2023 and the trial is at initial stage. He cannot be kept behind the bar for indefinite time, therefore, his regular bail may be allowed.

Bail application is opposed by learned counsel representing State. It is argued that there are specific serious allegations against petitioner who is husband of deceased victim. Allegations detailed in FIR are specific and clear. Post-mortem of the victim is Annexure R-1. In this case, cause of death is asphyxia due to hanging. Investigation was completed and challan was presented on 08.06.2023. Other co-accused Pahalwan Singh @ Pal Singh and Balwinder Singh @ Nikka were arrested on 06.12.2023. Petitioner is also involved in another FIR No.827 dated 13.09.2017 under Sections 506 and 34 IPC and Section 4 of POCSO Act. Considering the gravity of offence, he is not entitled to be released on bail. 5.
I have considered the arguments and have gone through the record. As per the facts, referred above, victim died unnatural death in the matrimonial home within a period of about one year of marriage. Kuldeep Singh brother of the victim lodged FIR with the allegations that accused were raising demand for dowry time and again and present petitioner was also having illicit relations with some other girl. Trial in this case is at initial stage. Statement of the complainant and other material witnesses are
yet to be recorded. Therefore, considering the gravity of offence, at this stage, I do not find it appropriate to grant regular bail and his regular bail application is accordingly declined.
