Learned counsel submits that the petitioner, who had superannuated on 30.11.2017, was granted only provisional pension and the retiral benefits were withheld on account of the fact that departmental enquiry was pending against him, which had, however, been dropped way back in the year 1999 itself, Annexure P-3. In the FIR No.182 dated 01.10.2016, he was found to be innocent on 05.07.2021, Annexure P-9, however still the retiral benefits have not been released, with regard to which representations dated 03.05.2019, 22.10.2020 and 14.07.2022, Annexures P7, P-8 and P-10, have been submitted followed by a legal notice dated 18.10.2022, Annexure P-12, which have yet not evoked any response. He, on instructions, prays that a direction may be given to the respondents to decide the same in a time bound manner, to which learned State counsel has no objection.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the legal notice dated 18.10.2022, Annexure P-12, within a period of 4 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. CWP-15489-2025 doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
