The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of award dated 04.09.2025 whereby ld. Permanent Lok Adalat (for short 'PLA') has directed it to issue No Dues Certificate to respondent No.2 without payment of Development Charges as well as directed for removal of the demand from the house bearing Property ID 1KHDAL65. It is further praying that operation of the impugned award may be kept in abeyance. 2.
As per pleadings, the respondent No.2 in order to secure loan against his house bearing Property ID 1KHDAL65 sought No Dues Certification from petitioner-MC Yamunanagar. The petitioner examined the matter and formed an opinion that development charges amounting to Rs.1,26,720/- are outstanding, thus, No Dues Certificate cannot be issued. CWP-15551-2026 -2not avail loan. He filed an application under Section 22C of 1987 Act before Ld. PLA which sought response of the petitioner. Matter was tried to be reconciled, however, was finally adjudicated on merits. Ld. PLA has concluded that the house in question is situated in an approved colony and petitioner had never issued any notice raising development charges, thus, there was no occasion not to issue No Dues Certificate. 3.
Learned counsel for petitioner seeks permission to withdraw the petition with liberty to file afresh with better particulars. 4.
Dismissed as withdrawn with aforesaid liberty. 5.
