(Oral) Mr. Mitul Singh Rana, Advocate has filed vakalatnama for respondent No. 5. The same be taken on record. Status report by way of affidavit of Sh. Surendra Lamba, IPS, Senior Superintendent of Police, Hoshiarpur, District Hoshiarpur filed in the Court today. The same be taken on record. A copy thereof has been supplied to learned counsel for the petitioner.

Para 5 of the Status report reads thus :- "5. That in compliance of order dated 11.02.2023 passed by Ld. Illaqa Magistrate, further investigation was carried out by investigating officer, but, no new facts or circumstances came up during said investigation and investigating officer again recommended for cancellation of present FIR, as ingredients/facts investigated does not constitute offence U/s 306/34 IPC against abovesaid accused persons and thus, investigating officer again recommended for cancellation of PARVINDER SINGH 2024.12.16 17:17 I attest to the accuracy and authenticity of this order/judgment

CRM-M-38316 of 2021 FIR and submitted a cancellation report dated 04.12.2024 before Ld. ACJM, Hoshiarpur on 05.12.2024 and Ld. ACJM, Hoshiarpur issued notice to complainant for 17.12.2024 for further proceedings."

In view of the abovesaid, learned counsel for the petitioner seeks to withdraw the petition in hand with liberty to avail further/alternative remedy as available in law.
