Mr. Amarjit Singh, Advocate, for the petitioner. ***** Rajan Gupta, J. (Oral) Petitioner has impugned award dated 27.11.2013 passed by Industrial Tribunal and Labour Court, Union Territory, Chandigarh whereby it was directed that respondent No.2-workman be reinstated in service with 25% back wages. At the time of issuance of notice of motion, operation of the impugned award to the extend of payment of back wages was stayed. Stand of the management is that after the award was passed, respondent No.2-workman has never approached the Management either to claim back wages or to join the post on which he was earlier working. An affidavit dated 26.10.2017 has also been filed in this regard. Even before this court, respondent No.2-workman did not appear despite service.

In view of the above, it appears that no cause of action survives in this petition. Same is hereby disposed of. Petitioner shall, however, be at liberty to seek revival thereof in case there is any change of circumstances.
