He has placed reliance on judgment of this Court passed in CWP No.4864 of 2011 decided on 20.11.2013, Hans Raj and others Vs. State of Haryana & another (Annexure P-9).

Learned AAG is not in a position to cite any contrary judgment. In the circumstances the petition is allowed in the same terms as in CWP No.4864 of 2011 decided on 20.11.2013, Hans Raj and others Vs. State of Haryana & another.
