Learned counsel submits that the petitioner had retired on 31.08.2020 on attaining the age of superannuation, however, has not been released retiral benefits on account of FIR No.1 dated 14.01.2019 having been registered against him under the Prevention of Corruption Act, wherefrom he was acquitted vide judgment dated 24.01.2024, Annexure P-2 and a legal notice dated 19.04.2025, Annexure P-3, has been served upon the respondents, postal receipts have been appended as Annexure P-4, which has yet not evoked any response. He, on instructions, prays that a direction may be given to respondent No.5 to decide the same in a time bound manner, to which learned State counsel has no objection. 2.
In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent No.5 to decide the legal notice dated 19.04.2025, Annexure P-3, within a period of 4 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
