...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. Ramesh Goyal, Advocate, for the petitioner.

G.S.SANDHAWALIA, J. (Oral) The relief claimed in the present writ petition is for the benefit of appointment as Lady Constable on compassionate basis on the ground that she has passed the trial conducted on 02.12.2014. It is the case of the petitioner that her father was working as Head Constable in the Punjab Police in SAS Nagar, Mohali and died while in harness on 19.08.2011. At that point of time, she was below 18 years and had submitted an application for appointment and was also called for trial which was held on 02.12.2014. It has been further alleged that police verification has also been conducted by the concerned authorities. The petitioner had served a legal notice dated 25.05.2015 (Annexure P-10) and even respondent no. 4, the Senior Superintendent of Police, SAS Nagar, Mohali, has written to respondent no.

2 for further course of action and necessary guidelines regarding the appointment but nothing has been done. Counsel submits that he would be satisfied at this stage if a direction is issued to the respondents to take a decision on the said legal notice within a time bound frame.

Keeping in view the limited relief sought and since the matter is SHIVANI GUPTA 2015.09.29 16:47 I attest to the accuracy and integrity of this document Chandigarh

-2pending consideration before the Authorities, this Court does not feel necessary to call upon the respondents to file reply. Accordingly, this writ petition is disposed of with a direction to respondent no. 2 to take into consideration the legal notice dated 25.05.2015 (Annexure P-10) and decide the same within a period of 3 months from the date of receipt of certified copy of the order. Needless to say that in case the relief is to be denied, the order should contain reasons. 24.09.2015 (G.S. SANDHAWALIA) shivani JUDGE SHIVANI GUPTA 2015.09.29 16:47 I attest to the accuracy and integrity of this document Chandigarh
