By this common order, CWP-14192-2018, CWP-141062018 and CWP-14142-2018 are disposed of as issues involved and prayer sought in all the petitions are common. For the sake of convenience and with the consent of parties, the facts are borrowed from CWP-141922018.

The petitioners are assailing order dated 22.12.2017 (Annexure P-4) whereby Labour Department, State of Haryana has made reference to Labour Court under Industrial Disputes Act, 1947. 3.

The respondents in its short reply dated 24.05.2023 has pleaded that they have authority to refer the matter because the petitioners are registered with them under Punjab Shops and Commercial Establishments Act, 1958. The petitioners on 09.11.2023 sought time to place on record documents to vindicate his stand that Central Government is an appropriate authority and respondent could not make reference.

On 09.11.2023, the following order was passed : "Short reply of Dr. Anuradha Lamba, Additional Labour Commissioner, Haryana, Chandigarh on behalf of respondent No. 1 filed in Court, is taken on record subject to all just exceptions.

Learned counsel for petitioners seeks a short accommodation to place on record documents in pursuance to which he was allocated the work of Toll Collection, Highway Routine Maintenance, Incident Management and Safety and Security of Men and Material at Rohtak-Hisar Section of NH10 in the establishment of Project Director, NHAI, PIU, Rohtak.

At his request, adjourned to 20.01.2024.

Interim order to continue till next date of hearing.

Mr. Sandeep Parkash Chahar, Advocate submits that he has no instruction or document in support of his submissions made on 09.11.2023. He multiple times contacted his client to supply requisite information but to no avail. Under these circumstances on earlier occasions, he sought time.
