(ORAL) This is a petition filed under Articles 226/227 of the Constitution of India seeking issuance of a writ of certiorari for setting aside/quashing of the order dated 07.01.2019 (Annexure P-5) passed by respondent No.2 and order dated 24.09.2019 (Annexure P-6) passed by respondent No.1, whereby the petitioner's application under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 for setting aside Transfer Deed No.3537 dated 25.10.2011 has been dismissed; and as also seeking directions for restraining respondent No.3 from alienating in any manner or creating any kind of encumbrance over Shop No.108/B-1-1688 situated near Old Head Post Office, Sadar Bazar, Nabha, District Patiala, during the pendency of the writ petition.

CWP-18301-2021 -2It is not even in dispute that the petitioner, who was the senior citizen, has since expired. Therefore, no interest of the senior citizen or of anybody else, who could have claimed through the senior citizen under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, survives any more. This petition has been rendered infructuous. Dismissed as having been rendered as infructuous. However, it is clarified that nothing observed by the authority/court in the course of the proceedings involved in the present case shall be read either in favour or against anyone of the legal representative(s) of the petitioner.
