(Oral) Learned counsel for the petitioners has fairly informed this Court that on a previous occasion, petitioner No.1 along with her daughter had approached this Court seeking protection by way of filing CRWP-72132021 wherein order dated 3.8.2021 (Annexure P-4) was passed. Learned counsel for the petitioners has submitted that petitioner No.1 was previously married to respondent No.4-Parveen, but since the behavior of her in-laws family was not cordial and she used to be harassed and in fact even her husband respondent No.4 is an addict and a drunkard, she was constrained to leave her matrimonial home and that as of now she is residing with petitioner No. 2 who has given shelter to her in his house. - 2 - CRWP-8857-2021 (O&M) This Court finds that in the earlier petition while petitioner No.1 as well as her husband Parveen (Resp No.4) were a party, petitioner No.2 was not arrayed therein. In fact all the private respondents except respondent No.9 were also arrayed in the previous writ petition i.e. CRWP7213-2021. In these circumstances, this Court does not find appropriate to issue any fresh directions qua petitioner No.1 and the petition on her behalf as such is dismissed.
However, as far as petitioner No.2 is concerned, without commenting anything as regards the averments made in the petition or as regards his relationship with petitioner No.1, the instant petition is disposed of with a direction to respondent No.2-Senior Superintendent of Police, SAS Nagar, Mohali, to look into the matter and to dispose of the representation dated 9.9.2021 (Annexure P-5) in accordance with law. In case, it is found that there is genuine threat to the life and liberty of the petitioner, then necessary steps warranted under law be taken thereupon at the earliest so as to ensure that no harm is caused to the petitioner.
