JASWANT SINGH, J (ORAL) The petitioner is a law Graduate having completed his five years Integrated Course B.A., LL.B (Hons) from the Panjab University Chandigarh with 57.2 % marks. He belongs to reserved category of Scheduled Castes (Majbi & Balmiki). The Cooperative Department had issued an Advertisement dated 30.7.2016 (P.3) for appointment to the posts of 300 Inspectors, Cooperative Societies. The last date for submission of online application was 22.8.2016. The application form of the petitioner was not considered as he was declared ineligible due to non-possessing of one of the essential qualifications of Graduation degree with 60% marks (as concededly the petitioner possesses 57.2% marks in his Graduation), hence the present petition challenging the clause 3

At the time of hearing today, it has emerged that the post of Inspector, Cooperative Department is governed by the Punjab Cooperative Group B Service Rules, 2016, notified on 21.3.2016 and as per Appendix B, it is statutorily provided that a candidate for being eligible inter alia must possess a graduation degree with 60% of marks. Since there is no challenge to the statutory rules, the present petition cannot proceed any further. Faced with the aforesaid situation, learned counsel prays for withdrawal of the petition with liberty to file fresh one, if so advised, challenging the statutory provisions as well.
