The present civil writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to promote the petitioner to the post of Chief Sanitary Inspector being fully eligible as per the Punjab Municipal Corporation Services (Recruitment and Conditions of Service) (Amendment) Rules, 2015.

Learned counsel for the petitioner inter alia contends that the Government of Punjab vide letter dated 12.01.2026 called for the petitioner's service record for considering him for promotion as the petitioner is the senior most candidate being at serial No.8 of the seniority list. The Municipal Corporation in compliance sent the original service book and ACRs of last five years on 06.03.2026. Further, 04 posts of Chief Sanitary Inspector are lying

-2vacant in Municipal Corporation, Amritsar. The post of Chief Sanitary Inspector is a Class C post and the competent authority is the Director, Local Government and no DPC is required. The petitioner is on the verge of retirement in May, 2026 and has been continuously working on the same post for the last 25 years. The petitioner became eligible for promotion in the year 2026 itself. Despite the admitted eligibility, the petitioner has continuously been denied consideration for promotion, which is contrary to the settled principles of law. Further, the case of the petitioner is squarely covered by the judgments rendered by this Court in CWP No.22784 of 2025 titled as Jaswinder Singh Vs. State of Punjab and others decided on 07.08.2025 and CWP No.5302 of 2026 titled as Kulwant Singh Vs. State of Punjab and others decided on 27.03.2026.

Learned counsel for the petitioner submits that the petitioner would be satisfied in case a time bound direction is given to respondent No.2 to treat the present writ petition as a comprehensive representation and consider the original service book of the petitioner and ACRs of the last 05 years and pass an appropriate order on the consideration of the promotion to the post of Chief Sanitary Inspector in light of Jaswinder Singh's case (supra) and Kulwant Singh's case (supra).

Ms. Pratibha Bali, AAG, Punjab puts in appearance on receipt of advance notice and submits that she has no objection in case a direction is issued to respondent No.2 to consider service record of the petitioner received from the Municipal Corporation vide letter dated 06.03.2026, and pass an appropriate speaking order in accordance with the law.

Keeping in view the fact that the petitioner is going to superannuate on 31.05.2026, the present petition is disposed of according and respondent No.2 is directed to consider his service record received from Municipal Corporation vide letter dated 06.03.2026 and pass an appropriate order in light of the judgments passed by this Court in Jaswinder Singh's case (supra) and Kulwant Singh's case (supra), within a period of one week from the date of receipt of certified copy of this order, failing which, the petitioner would be at liberty to move an appropriate application under Article 215 of Cr.P.C. of the Constitution of India to initiate contempt of Court proceedings. 6.

The copy of this order be handed over the learned State counsel for information and strict compliance.
