(ORAL) Instant writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing respondents No.1 to 3 to decide the case of separation of the Gram Panchayat Tatka, Tehsil and District Kurukshetra by creating a separate Gram Panchayat of Village Tatki. Heard.
Learned counsel for the petitioner submits that issue with regard to separation of Villages Tatka and Tatki is pending before the Government since long. Earlier petitioner and another approached this Court by filing CWP No.6704 of 2010 wherein following order was passed on 01.07.2010: - "Learned counsel for the petitioners states that representation RAVINDER SINGH 2015.02.09 16:25 I attest to the accuracy and authenticity of this document
-2CWP No.2054 of 2015 dated 6.2.2009 (Annexure P-1) moved by the petitioners is not being decided by respondent No.2.
Without expressing any opinion on the merits of the case, petition is disposed of with the direction to respondent No.2 to take decision on the representation of the petitioners dated 6.2.2009 (Annexure P-1) within two months from the date of production of a certified copy of this order. Petition stands disposed of accordingly."
Learned counsel for the petitioners submits that in pursuance of the order passed by this Court on 01.07.2010, intimation dated 17.01.2011 (Annexure P-8) was sent by Director Development and Panchayat Department, Haryana that proposal of bifurcation of the Gram Panchayat Tatka would be considered at the time of next general elections to the Panchayati Raj Institutions. Learned counsel submits that fresh elections are likely to be held in the month of April/May, 2015, however, despite representation no action has been taken by the authorities.
In view of above, present writ petition is disposed of with a direction to respondent No.2 to take decision with regard to bifurcation of Gram Panchayats of Villages Tatka and Tatki within a period of one month from the date of receipt of certified copy of this order.
