The limited prayer in the present revision petition is for directing the Trial Court to decide the application under Order 39 Rules 1 and 2 of the Code of Civil Procedure, 1908 which has been pending since 2019.

Learned counsel for the petitioner would contend that initially after the filing of the suit an application was filed under Order 1 Rule 10 CPC by the defendant-respondents. Thereafter, due to Covid-19 the matter could not be taken up. However, the application under Order 1 Rule 10 CPC was dismissed on 03.10.2023 (Annexure P-5).
